  • illuminea reserves the right to cancel the service at any time. In this event, Client will be entitled to a pro rata refund based upon the remaining subscription period. If Client violates illuminea’s terms of service, a refund will not be issued in the event of a cancellation.
  • Client may cancel services at any time. All subscription fees charged to Client in the event of cancellation by Client are non-refundable.
  • illuminea reserves the right to revise the maintenance fees at any time upon thirty (30) business days notice in writing to Client of such proposed revisions. If such proposed revisions are unacceptable to Client, Client may terminate this agreement and receive a refund for the remaining paid subscription period. In the event that Client continues to use the services after the date of notice, Client is deemed to have accepted the revisions as proposed in the notice of revision.
  • illuminea shall not be responsible for any claimed direct or indirect damages, including incidental and consequential damages, which may arise from servers going off-line or being unavailable for any reason. Furthermore, illuminea shall not be responsible for any claimed damages resulting from the corruption or deletion of any website.
  • illuminea provides up to the number of hours indicated in each package of technical and bug support per month, and this covers standard issues related to the functioning of the site.
  • Should Client or any other third-party except illuminea make alterations to the site, including but not limited to adding or removing plugins, editing the theme files, or modifying the underlying PHP/MySQL, illuminea will no longer take responsibility for the site’s functioning. If there is a resulting problem from this type of alteration, illuminea can provide development services to fix it with our time bank offering (see

  • In the event that Client’s data is lost from Client’s servers, illuminea shall restore the backup data to Client’s servers. illuminea shall not be responsible for files that cannot be recovered due to corrupt data, fires or any other disaster or event not in control of illuminea.
  • From time to time, Client may have unanticipated circumstances which cause their web sites to exceed bandwidth and/or storage limits. In the event that Client exceeds allotted disk space and/or data transfer limit, illuminea shall notify Client to discuss upgrading plans for additional disk space and/or data transfer capacity.
  • The Client agrees to indemnify and save illuminea from and against all losses, damages, actions or causes of action, suits, claims, demands, penalties and interest arising in connection with or out of any illegal use of the website.
  • In the event any portion of this agreement is deemed to be invalid or unenforceable, such portion shall be deemed severed and the parties agree that the remaining portions of this agreement shall remain in full force and effect.
  • Neither party may assign or otherwise transfer these Terms of Service without the written consent of the other party.
